Welcome to MelodyMap (“we,” “us,” “our”), a music educator directory platform operated by Second Difference Solutions LLC. These Terms of Service (“Terms”) govern your use of the MelodyMap website at melodymap.io and all related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Definitions
- “Student” or “User” refers to any individual who uses MelodyMap to search for music educators, submit pre-enrollment requests, or browse educational content.
- “Educator” refers to any music teacher, instructor, music school owner, or business that creates a profile, lists services, or participates in the MelodyMap directory.
- “Pre-Enrollment Request” refers to a submission by a Student expressing interest in lessons with a specific Educator through the MelodyMap platform.
- “Referral Program” refers to the lead-generation program through which Educators receive Student contact information in exchange for a per-referral fee.
2. Eligibility
You must be at least 18 years old to create an Educator account or enroll in the Referral Program. Students under 18 may use the search functionality with parental or guardian consent. By using the Service, you represent that you meet these requirements.
3. Student and User Terms
3.1 Use of the Directory
Students may search for music educators by location and browse educator profiles at no cost. Search results are influenced by publicly available business data, educator-provided information, and relevance to the search query.
3.2 Pre-Enrollment Requests
When you submit a Pre-Enrollment Request, you provide contact information (such as your name, email, and phone number) that will be shared directly with the Educator you selected. By submitting a Pre-Enrollment Request, you consent to having your contact information shared with that Educator for the purpose of discussing music lessons.
MelodyMap does not guarantee that any Educator will respond to your request, accept you as a student, or provide lessons at any particular price or schedule.
3.3 No Agency Relationship
MelodyMap is a directory and referral platform. We do not employ, endorse, or certify any Educator listed on the platform. We are not a party to any agreement between Students and Educators. Any lessons, payments, or arrangements made between Students and Educators are solely between those parties.
3.4 Accuracy of Information
We strive to present accurate information about Educators, including data sourced from Google Places and educator-provided profiles. However, we do not warrant that any information on the platform is complete, current, or error-free. Students should verify lesson details, pricing, and credentials directly with the Educator.
4. Educator Terms
4.1 Educator Profiles and Content
By creating an Educator profile on MelodyMap, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute the information and content you provide, including but not limited to:
- Business name, address, phone number, and website
- Descriptions of services, lesson types, and specializations
- Photographs, logos, and other media you upload
- Reviews, ratings, and other publicly available business data imported from third-party sources (such as Google Places)
This license allows us to feature your profile in search results, promotional materials, directory listings, and advertising on the MelodyMap platform and in connection with marketing efforts to attract students to the platform. This license continues for as long as your profile remains active on the platform. You may request removal of your profile by contacting us at info@melodymap.io, and we will remove your content within a reasonable timeframe.
4.2 Use of Business Information for Advertising and Promotion
You acknowledge and agree that MelodyMap may use information from your Educator profile — including business name, location, services offered, and any imported Google Places data — to create directory listings, landing pages, and promotional content designed to connect students with music educators. This may include:
- Displaying your business information in search results alongside other Educators
- Featuring your profile on location-based or instrument-based landing pages
- Using your business information in email campaigns, social media, or other marketing channels to promote the MelodyMap directory
You represent that you have the right to provide all content included in your profile and that such content does not infringe on any third party’s rights.
4.3 Google Places Data
MelodyMap may import publicly available business data from Google Places (such as reviews, ratings, hours of operation, and photos) to supplement your Educator profile. This data is sourced from Google’s public APIs and is displayed in accordance with Google’s Terms of Service. You may request that imported data be removed from your profile by contacting us.
4.4 Accuracy of Educator Information
You are responsible for keeping your profile information accurate and up to date. MelodyMap is not responsible for outdated or incorrect information on Educator profiles.
5. Referral Program Terms
5.1 Enrollment
The Referral Program is available to Educators at the Basic tier and above. By enrolling in the Referral Program, you agree to the terms in this section.
5.3 Referral Fees
- The current referral fee is $15.00 per qualified Pre-Enrollment Request.
- A charge is triggered when a Student submits a Pre-Enrollment Request for your business through MelodyMap. The charge occurs regardless of whether the Student ultimately enrolls in lessons with you.
- MelodyMap reserves the right to adjust the referral fee with 30 days’ advance notice. Continued participation in the Referral Program after the effective date of a fee change constitutes acceptance of the new fee.
5.4 Billing and Payment
- Referral fees are charged to your Payment Method on file at the time the Pre-Enrollment Request is sent.
- You are responsible for ensuring your Payment Method is valid and has sufficient funds. If a charge fails, we may retry the charge and/or suspend your participation in the Referral Program until payment is received.
- All fees are non-refundable except in the case of duplicate or erroneous charges, which you may dispute by contacting info@melodymap.io within 30 days of the charge.
5.5 Cancellation
You may cancel your participation in the Referral Program at any time through your Educator Dashboard. Cancellation takes effect immediately, and you will not be charged for any Pre-Enrollment Requests received after cancellation. Fees for Pre-Enrollment Requests received before cancellation are not refundable.
6. Subscription Plans
6.1 Paid Tiers
MelodyMap offers paid subscription tiers (Pro and Plus) with additional features and benefits. Subscription pricing, features, and terms are described on the Educators page and within the Educator Dashboard.
6.2 Billing
Subscriptions are billed monthly through Stripe. By subscribing, you authorize recurring monthly charges to your Payment Method until you cancel. You may cancel your subscription at any time through the Educator Dashboard or by contacting us.
6.3 Cancellation and Refunds
When you cancel a subscription, you retain access to paid features through the end of your current billing period. Partial-month refunds are not provided.
6.4 Changes to Plans
We reserve the right to modify subscription pricing or features with 30 days’ advance notice. Existing subscribers will be notified of changes before they take effect.
7. Acceptable Use
You agree not to:
- Provide false or misleading information in your profile or search queries
- Use the Service to spam, harass, or send unsolicited communications
- Scrape, crawl, or use automated means to access the Service without our written consent
- Attempt to gain unauthorized access to other users’ accounts or MelodyMap systems
- Use the Service for any unlawful purpose
- Interfere with or disrupt the Service or its infrastructure
We reserve the right to suspend or terminate accounts that violate these Terms.
8. Intellectual Property
8.1 MelodyMap Content
All content, design, code, and trademarks on the MelodyMap platform (excluding user-provided content) are owned by or licensed to Second Difference Solutions LLC. You may not copy, reproduce, or distribute our content without written permission.
8.2 User Content
You retain ownership of content you provide to MelodyMap, subject to the license granted in Section 4.1. You are solely responsible for ensuring that your content does not violate any laws or third-party rights.
9. Third-Party Services
MelodyMap integrates with third-party services including Google Places API, Google Analytics, Stripe, and Firebase (Google Cloud). Your use of the Service is also subject to the terms and privacy policies of these third-party providers. MelodyMap is not responsible for the practices of third-party services.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
MELODYMAP DOES NOT ENDORSE, CERTIFY, OR GUARANTEE THE QUALIFICATIONS, QUALITY OF INSTRUCTION, OR SUITABILITY OF ANY EDUCATOR LISTED ON THE PLATFORM. STUDENTS USE THE DIRECTORY AND SELECT EDUCATORS AT THEIR OWN DISCRETION AND RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECOND DIFFERENCE SOLUTIONS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO MELODYMAP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Second Difference Solutions LLC from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party’s rights.
13. Modifications to Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date and, for Educators with active accounts, provide notice through the Educator Dashboard or via email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of West Virginia, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in West Virginia.
